It is possible to make a claim even if:

  • Your exposure to asbestos occurred many decades ago

  • Your employer went out of business years ago

  • You were self-employed

  • Your exposure did not occur at work

James Hardie Inquiry

Slater & Gordon played a crucial role in the conduct of the recently concluded Special Commission of Inquiry into the Establishment of the Medical Research and Compensation Foundation. James Hardie had established a trust fund to meet its future asbestos liabilities. An inquiry was called after it was alleged that the trust had been under-funded by over $2 billion. The firm acted, and continues to act, for unions and asbestos support groups without charge in order to ensure that the future victims of James Hardie are compensated for their injuries.

In the wake of the Commissioner's report, Slater & Gordon continued to play a key role in ensuring the future availability of asbestos compensation. Having successfully obtained adverse findings against the company, Slater & Gordon drew on its legal knowledge, and practical experience in asbestos litigation, to advise stakeholders in their negotiations with James Hardie.

This has resulted in a landmark multi-billion dollar settlement under which the company has committed to fully compensating Australian asbestos victims now and into the future. Slater & Gordon is now acting on behalf of the ACTU in the finalisation of this agreement.
